Relationship Property & Trusts


When a relationship ends, the assets and debts need to be divided. The starting point is that relationship 

property is divided equally, however, there are exceptions to this. To be binding, the division needs to be

recorded in a court order or a separation agreement, signed by each of you and certified by your

independent lawyers. 

As your lawyer, I will assess your circumstances and advise you on the division of your relationship

property and trust assets. 

I will negotiate the division on your behalf and represent you at mediation or in court proceedings.

In some circumstances it is necessary to engage an accountant to value your claims or businesses. 

Child Support 



Child support is usually administered through IRD, unless there is a private agreement.

If you disagree with the amount of child support, you can apply for a review through IRD.

 

If the IRD's decision is disagreed with, an appeal can be made to the Family Court.

 

I can assist you through these processes. 

Care of Children

 


When a relationship ends, care arrangements for your children need to be decided.

 

This is often negotiated through lawyers, or where agreement can't be reached, court proceedings are filed in the Family Court.

 

The Family Court is also involved when there are guardianship disputes - about important matters affecting your children, including where they reside in New Zealand, overseas travel and name changes. I can represent you through these processes. 

Contracting Out Agreements



Contracting out agreements are used when a couple wants to keep some assets as their separate property. 
 

This is common where one person has received an inheritance or enters the relationship with assets, including from a previous marriage.

I can draft the agreement and provide independent advice to you. Your partner will need to receive independent legal advice from their own lawyer.

If your partner has had an agreement drafted by their lawyer, I can advise you on this.

Maintenance & Economic Disparity


When a relationship ends, financial support needs to be considered.

Where one spouse or partner cannot meet their reasonable needs, due to the circumstances of the relationship, maintenance may be payable. 

 

Maintenance is often negotiated through lawyers, or where agreement can't be reached, court proceedings are filed in the Family Court.

 

Economic disparity is payable where, at the end of a relationship, the income or living standards of one partner are likely to be significantly higher due to the effects of the division of functions during the relationship.

I can advise you on these aspects of your financial separation.
